These Terms of Use are issued by NEXA Mortgage LLC (NMLS #1660690), doing business as Stairway Mortgage (“Stairway Mortgage,” “we,” “us”). Last updated: October 24, 2026.
1. Agreement
These Terms apply to stairwaymortgage.com, any other website or landing page we operate that links to them, the Stairway mobile app, and our calls, texts and emails (together, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility. You must be at least 18 years old and a U.S. resident to use the Services.
2. Who we are
NEXA Mortgage LLC is a mortgage broker and mortgage lender. Stairway Mortgage is a division and registered trade name of NEXA Mortgage LLC. Requests made through the Services may be handled by any NEXA Mortgage LLC loan officer licensed in your state. Licensing information is on our State Licensing page and at NMLS Consumer Access.
3. Not a commitment to lend
Rates, payments, quotes, pre-qualifications, calculators, home values, equity and cash flow estimates, and other information on the Services are estimates for information only. They are not a commitment to lend, an offer of credit, a rate lock, an appraisal, or tax, legal or financial advice. Loans are subject to application, credit and income approval, underwriting, property appraisal and program guidelines. Rates, terms and programs may change without notice and vary by state. Not all applicants will qualify.
4. License to use
We grant you a limited, personal, non-transferable, revocable license to use the Services for your own mortgage, real estate and financial planning purposes. You may not copy, resell, scrape, frame or redistribute the Services or their content, use bots or automated tools against them, attempt to access accounts or data that are not yours, or interfere with their security or operation.
5. Your account and the app
You are responsible for the accuracy of information you provide and for keeping your login, password and verification codes secure. You may use the app only on devices you own or control. We may suspend or close accounts that violate these Terms or put other users at risk. When you connect bank accounts through Plaid or use other third-party features, their terms also apply. For apps downloaded from the Apple App Store, Apple is not responsible for the app or its support, and Apple and its subsidiaries are third-party beneficiaries of these Terms.
Connecting with other people. The app lets you connect with loan officers, real estate investors, agents and other professionals. We verify identity to help keep the community safe, but we do not guarantee the conduct, advice or services of any other person or business. Use your own judgment before meeting or doing business with anyone.
6. Proprietary rights
All content on the Services, including text, images, data, software, the Stairway name and logo, The 8 Steps™, Relocate Anywhere™ and other trademarks, is owned by or licensed to us and protected by U.S. and international copyright and trademark laws. Using the Services does not give you any ownership of it.
7. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not guarantee that the Services will be accurate, complete, uninterrupted or error-free.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEXA MORTGAGE LLC, STAIRWAY MORTGAGE AND THEIR OFFICERS, EMPLOYEES, LOAN OFFICERS AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. Our total liability for any claim relating to the Services is limited to $100. Some states do not allow these limits, so they may not apply to you. Nothing in these Terms limits rights you have under consumer protection or lending laws that cannot be waived.
9. Indemnification
You agree to indemnify and hold harmless NEXA Mortgage LLC, Stairway Mortgage and their officers, employees, loan officers and agents from claims, losses and legal fees arising from your misuse of the Services, your violation of these Terms, or your infringement of anyone else’s rights.
10. Governing law and venue
These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law rules. Any dispute relating to the Services will be resolved in the state or federal courts located in Maricopa County, Arizona, where our corporate office is located at 5559 S Sossaman Rd, Bldg 1, Ste 101, Mesa, AZ 85212, unless the law of your state requires otherwise.
11. Children
The Services are not intended for anyone under 18, and we do not knowingly collect information from children under 13. Parents can use filtering software to restrict access. See our Privacy Policy.
12. Export control
You must comply with U.S. export laws and may not use or transmit the Services or their software in violation of them.
13. Changes and interruptions
We may change, suspend or discontinue any part of the Services, or update these Terms, at any time. Updated Terms take effect when posted with a new “Last updated” date. We are not responsible for interruptions or outages.
14. Third-party links
The Services may link to third-party websites and services for convenience. We do not endorse or control them and are not responsible for their content or policies. You use them at your own risk.
15. Copyright infringement claims (DMCA)
If you believe content on the Services infringes your copyright, send a written notice to our designated agent that includes:
- your physical or electronic signature;
- identification of the copyrighted work you claim is infringed;
- identification of the material you claim is infringing and where it appears on the Services (such as the page URL);
- your name, address, phone number and email;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

If we remove material in response to a notice, the person who posted it may send a counter-notice to the same agent. We may close the accounts of repeat infringers.
16. Product disclosures
- FHA, VA and USDA loans: subject to underwriting approval and program requirements, including occupancy and eligibility rules.
- Reverse mortgages: borrowers must complete HUD-approved counseling, live in the home, and keep paying property taxes, homeowners insurance and maintenance, or the loan may become due.
- HELOCs and second mortgages: your home secures the loan; failure to repay may result in foreclosure. Rates may be variable.
- Construction, renovation and bridge loans: subject to additional requirements, draw schedules and reserves.
17. Security and vulnerability reporting
We use safeguards such as encryption and firewalls. To report a security vulnerability, email info@nexamortgage.com or privacy@stairwaymortgage.com with “Vulnerability Disclosure” in the subject line. Do not access, change or delete data that is not yours while testing.

19. Equal Housing Opportunity and fair lending
NEXA Mortgage LLC dba Stairway Mortgage is an Equal Housing Opportunity company and Equal Housing Lender. We do not discriminate on the basis of race, color, religion, national origin, sex, handicap or disability, familial status, marital status, age (provided the applicant can enter a contract), because all or part of the applicant’s income comes from a public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agencies that administer compliance with these laws include the Consumer Financial Protection Bureau, 1700 G Street NW, Washington, DC 20552, and the Federal Trade Commission, Equal Credit Opportunity, Washington, DC 20580.
20. “Refi 36” offer terms
Offer. Stairway Mortgage offers qualified customers up to $2,500 in lender credits toward Covered Fees when they refinance a first-lien purchase or refinance mortgage (“Mortgage Loan”) with Stairway Mortgage within 36 months of the original closing date. Eligibility begins 180 days after the original funding date. The offer is valid only through the Stairway Mortgage branch of NEXA Mortgage LLC and cannot be redeemed through any other NEXA branch or team.
How the credit is provided. The credit is provided through the new loan’s pricing as a lender credit and will be shown on your Loan Estimate and Closing Disclosure.
Covered Fees: lender’s and owner’s title insurance; appraisal, including second appraisals, re-inspections and recertifications; flood certification; credit report; and settlement fees, including notary, recording, transfer taxes, government fees, deed preparation, courier and endorsements. Not covered: discount points and any cash back to the borrower.
Eligibility. You must be a U.S. citizen, permanent resident or eligible non-permanent resident refinancing a primary residence in a state where NEXA Mortgage LLC is licensed; have closed your Mortgage Loan with Stairway Mortgage between January 1, 2025 and December 31, 2030; refinance within 36 months of the original closing date; and tell your loan officer about the offer before locking your rate.
Other terms. One refinance per Mortgage Loan. Cannot be combined with other offers. No cash value; credits cannot exceed actual Covered Fees. All loans are subject to standard underwriting and credit approval. This is not a commitment to lend. We may change or end this offer at any time without notice; rates, terms and eligibility vary by state.
21. Text messaging terms
Program. By providing your mobile number and opting in, you agree to receive text messages from Stairway Mortgage about loan application updates, phone verification codes, account alerts, mortgage market updates and promotions, follow-ups on mortgage reviews, holiday messages and service referrals. Messages may be sent through platforms such as RingCentral, GoHighLevel, Telnyx, Twilio and similar providers. Consent is not a condition of any purchase or loan.
Frequency and cost. Message frequency varies. Message and data rates may apply.
Opt out. Reply STOP to any message to cancel; you will receive one confirmation text. Reply HELP for help, or call (954) 993-1625.
Mobile privacy. No mobile information or phone numbers will be shared with third parties, affiliates or partners for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third party, except the providers that deliver our messages. See our Privacy Policy.
